These informative sessions delved into the world of AMLCFT for gaming\, covering crucial topics such as requirements\, typologies\, supervision\, risk assessment\, and coordination with other competent authorities like the FIU and/or the LEAs. This aligns perfectly with the actions emphasised in the FATF Post Observation Progress report. \n  \n💼 Today\, on May 19th\, we launched Session 3 on IO 3/Supervision\, going in-depth on the following crucial aspects: \n\n1️⃣ Identifying clients: Understanding the importance of accurately identifying clients within the gaming sector.\n2️⃣ Verifying information: Emphasising the significance of verifying client information to ensure transparency and accountability.\n3️⃣ Recording data: Highlighting the need to maintain proper records of all relevant information.\n4️⃣ Detecting suspicious transactions: Equipping participants with the skills to identify suspicious transactions within the gaming industry.\n5️⃣ Disseminating suspicious transactions to the FIU: Establishing effective channels for promptly reporting any suspicious activity to the Financial Intelligence Unit.\n\n  \nWe extend our sincere congratulations and gratitude to the gaming authority in Mozambique for their strong engagement and commitment towards enhancing AML/CFT practices in the country. \nSpecial thanks and recognition also to Paulo Lopes\, Gaming Authority in Portugal\, for his invaluable contributions and support in this endeavour.[/vc_column_text][/vc_column][/vc_row]

Together\, we explored the implications of the FATF’s updated Recommendation 24 and its impact on the EU GF’s work with partner countries. \n2️⃣ Mr Stien also shared insights and expertise on using assessments made by other international bodies in the context of the EU GF’s work with partner countries. The EU GF firmly believes in leveraging existing assessments to strengthen the implementation of effective measures. \n3️⃣ Our Expert provided valuable guidance on the priorities countries should focus on when implementing a sustainable Beneficial Ownership (BO) framework. The importance of early engagement\, high-level and operational commitment\, strong public-private partnerships\, and forward-looking implementation measures were emphasised. \n4️⃣ The EU GF was invited to partake in the Technical Assistance and Training Working Group (TATWG) where Mr Stien presented a comprehensive overview of the activities conducted with MENA countries since 2020. \n“We are proud to have trained over 3\,000 individuals during almost 100 different activities. In addition to bilateral activities conducted with partner countries such as Algeria\, Jordan\, Morocco\, Tunisia\, and the UAE\, we have also organised numerous regional events to foster knowledge sharing and collaboration\,” he stated. \n📅 Upcoming events include: “Strengthening Judicial Cooperation in the MENA Region: Integrated Approaches to the Investigation and Prosecution of Money Laundering” in Rabat\, 5th-7th June 2023. \nWe are humbled to have received a “Certificate of Appreciation” from MENAFATF Executive Secretary Suliman Al Jabrin\, who recognised the project’s significant contributions to the group’s activities in 2022. This recognition further strengthens our commitment to continue and enhance our collaboration with MENAFATF. \n👏🏽👏🏽🤝🤝 We extend our heartfelt gratitude to all the members\, observers\, and participants for their valuable contributions and engaging interactions throughout the event. Launched in March 2023 in Buenos Aires for the GAFILAT and CFATF regions\, the activity was replicated in Warsaw for the MONEYVAL region a month later. The conference is being held in collaboration with the Eastern and Southern Africa Anti-Money Laundering Group (ESAAMLG) secretariat and the Financial Intelligence Centre of the Republic of South Africa. \nHeld under the title “Beneficial Ownership Disclosure Frameworks in Practice – From Risk Assessment to Beneficial Ownership Registers”\, the three-day conference  will witness the participation of more than 70 representatives from 18 countries on the African continent\, as well as the participation of  (TBC)  attendees online. \n  \nIn  her opening remarks\, Director of the FIC of South Africa\, Adv Xolisile Khanyile said “Criminals rely on being able to hide their proceeds and creating distance between themselves and the source of their illicit proceeds. By having timely and accurate information on the beneficial owners of accounts and of property held by corporate vehicles\, as well as the source of funds for corporate vehicles\, we will be able to better protect the financial system from abuse.”  \n  \nFor her part\, ESAAMLG Executive Secretary Fikile Zitha\, noted: “this workshop\, which is a continuation of the regional BO workshop held in September 2022 in Lusaka\, aims to assist member countries in the proper application of transparency of legal persons and arrangements including the establishment of an appropriate framework capturing beneficial ownership information.”“With the great turnout we are seeing today\, it sends a strong signal of commitment for adapting to the revised changes being brought\,” she added. \n  \nThe regional workshop\, which will consist of interactive exchanges and open discussions\, will allow participants to exchange best practices and further deepen their expertise on BO-related matters. Thematic presentations shall also be delivered by experts from Belgium\, Latvia\, Ukraine and Mozambique. \n“Today’s conference shows the European Union’s strong commitment to combatting financial crimes and promoting transparency in the global financial system. We bring together representatives from many African countries\, we foster collaborative efforts to establish effective beneficial ownership frameworks and we ultimately collectively safeguard our economies from illicit activities. The EU stands firm in its support for this conference. Together\, we can build a more secure and accountable financial landscape for the prosperity of all\,” said European Union Ambassador to South Africa\, Sandra Kramer. \n  \nFor his part\, EU Global Facility Team Leader David Hotte welcomed the participation of representatives from 18 countries\, saying “it is particularly impressive to witness the attendance of so many countries\, which shows African nations’ committment to the enhancement of beneficial ownership frameworks within their respective jurisdictions. I am confident that these three days of exchanges will yield great results on  risk assessment related to BO and BO registers”. \nThe conference is part of a series of technical assistance activities delivered by the EU GF-AML/CFT to partner countries around the world. Demand driven and tailor-made\, the support is provided on a bilateral\, regional and thematic basis. Launched in March 2023 in Buenos Aires for the GAFILAT and CFATF regions\, the activity was replicated in Warsaw for the MONEYVAL region a month later and in Cape Town (ESSAMLG\, GABAC and GIABA regions) in May 2023. By fostering collaboration among these crucial stakeholders\, the training aimed to enhance the effectiveness of statistical practices and support Ecuador’s ongoing efforts to combat financial crimes. \n📊 The training series -the first to be delivered on the subject of statistics by the EU Global Facility- was officially requested by Ecuador. The EU Global Facility has recognised the significance of this challenge and has been providing support to microfinance institutions in Tunisia and Jordan to address these issues. \nOn Wednesday 12th of July 2023\, Jordan’s microfinance institution Tamweelcom achieved a significant milestone by obtaining the AML 30 000 certification\, solidifying their commitment to combating financial crime. \nThe certification ceremony\, held in the presence of representatives from the EU Delegation (EUD) to Jordan\, was opened by Bashar Arafeh\, Chairman of Tamweelcom. His speech was followed by the congratulations of David Hotte\, Team Leader of the EU Global Facility\, who noted: “on behalf of the EU Global Facility\, I want to warmly congratulate Tamweelcom on their remarkable achievement. This certification is a testament to their unwavering commitment to upholding the highest standards of financial integrity and actively combating the risks of money laundering and terrorist financing”.  \n“Tamweelcom’s dedication and exemplary efforts serve as an inspiration to the entire microfinance sector. We\, at the EU Global Facility\, commend their remarkable accomplishment and are confident that their leadership will encourage other financial institutions in the region to follow suit. It does so by funding the variety of collaborative initiatives and partnerships conducted by the EU Global Facility project. \nFrom the 17th to the 21st of July\, some 35 hand-picked representatives from 15 French-speaking jurisdictions will familiarise themselves with the highest FATF standards\, paving the way for enhanced compliance and strengthened anti-money laundering measures in their respective jurisdictions. \nIn attendance are participants from five Financial Action Task Force-Style Regional Bodies (FSRBs)\, namely ESAAMLG (Madagascar\, Burundi)\, GABAC (Chad\, Congo\, Democratic Republic of Congo\, Cameroon\, Gabon\, Central African Republic)\, GIABA (Senegal\, Benin\, Comoros\, Togo\, Guinea\, Burkina Faso) and GAFIC (Haiti). \nThis joint training initiative represents a remarkable milestone in the ongoing efforts to combat financial crimes and establish a more secure global financial system. Well done on a fruitful event! \nThis is the 3rd time the EU Global Facility is invited to partake in the GAFILAT Plenary\, and we’re grateful for the opportunity to strengthen our partnership. \nDuring four days of fruitful meetings\, our Senior Expert on Justice Victoria Palau Tárrega attended the plenary -opened over by Panama’s President-\, delivered a presentation on the EU GF’s successful endeavours in the region and conducted bilateral meetings with a number of regional stakeholders.\nIn close collaboration with the GAFILAT\, the EU Global Facility recently organised a high-level regional conference on art trafficking and AML/CFT in Mexico and the organisation of a regional conference on beneficial ownership scheduled to take place in Argentina in November is currently underway. \nOur expert also took part in bilateral meetings with countries receiving the project’s technical assistance\, including Panama\, Argentina\, Ecuador\, Uruguay\, and Paraguay. The project is also currently exploring potential collaborations with other countries\, reaffirming our commitment to impactful partnerships. \nA coordination meeting among observers and technical assistance providers also took place\, aimed at optimising technical support in the region and avoiding duplication.[/vc_column_text][/vc_column][/vc_row]

This friction has led to various decisions and opinions from different authorities\, bodies\, and stakeholders. \nThe 4th EU AMLD in 2015 required every member state to set up BO Registers\, gathering and verifying BO information to be made available to various stakeholders\, including members of the general public upon the demonstration of their legitimate interest to access the information. In 2018\, the 5th AMLD removed the condition of legitimate interest for the access to members of the general public\, but a contentious ruling by the ECJ in November 2022 invalidated this unconditional access based on privacy rights concerns. The ECJ ruled that a legitimate interest must be demonstrated to access such information\, reinstating the 4th AMLD conditionality. \nTo discuss the implications of the ECJ ruling\, the EU Global Facility organised a Roundtable where experts shared their practical insights on the impact of the ruling on the effectiveness of BO disclosure and AML frameworks\, as well as possible legal and operational solutions available to address the concerns raised by the court. \nDuring the roundtable\, experts representing stakeholders from both public and private sectors discussed various challenges\, including the balance between transparency and privacy\, data quality concerns in BO registers\, and the importance of access to BO information for investigative purposes.\nThe open discussion highlighted the need for further debate and the importance of finding a long-term solution that can strike a balance between privacy rights\, data protection\, and the need for access to information in the fight against financial crimes. \nThe EU Global Facility is now working to organise sub-groups of experts to prepare documents on key topics\, such as defining legitimate interests\, technological solutions available to exchanging BO information\, and protecting those with a legitimate interest from tipping off. \nStay tuned for more updates on this crucial topic as the European Commission\, the European Parliament\, and the Council are set to finalise their discussions on the upcoming AML Package.[/vc_column_text][/vc_column][/vc_row]

Today we open a three-day regional event in Indonesia 🇮🇩  in collaboration with the Global NPO Coalition on FATF. \nTaking place from July 25th to 27th\, this Regional Consultation brings together together 50 NPO representatives from the APG and Central Asia countries\, including Bangladesh\, Cambodia\, Hong Kong\, India\, Indonesia\, Kazakhstan\, Kyrgyzstan\, Malaysia\, Mongolia\, Nepal\, Pakistan\, Philippines\, Sri Lanka\, and Thailand as well as from Croatia\, Georgia\, the Netherlands\, the Republic of Moldova\, Russia and the UK. Representatives of the APG Secretariat as well as the authorities of the host country – Indonesia – will also be in attendance. \nWe are also happy to announce that the Chairperson of MONEYVAL and representatives from the EU Delegation to Jakarta will also address the audience. \nThe primary objective of this meeting is to discuss the upcoming revision of the Financial Action Task Force (FATF) Recommendation 8 Best Practices Paper (BPP) by the FATF. The Rec 8 BPP revision is a crucial step towards aligning international standards with the evolving needs and realities of NPOs. It shall also serve as an opportunity to review the plans for the upcoming months and explore potential areas for collaboration between the two initiatives. \nOne significant event on the agenda is the planned global consultations of Non-Profit Organisations (NPOs) in September 2023in Bonn. This consultation aims to address the ongoing reform of the FATF Recommendation 8 and its Best Practices Paper\, representing a crucial milestone in their collective efforts to combat money laundering and terrorist financing in the not-for-profit sector. \nThe EU Global Facility and GIZ IFF projects have been maintaining regular contacts to ensure that their activities in regions of mutual interest\, such as Africa and Latin America\, do not overlap or duplicate efforts. It brought together competent authorities from the UAE\, Jordan\, Austria\, Belgium\, Luxembourg and Malta\, with the aim of fostering cooperation and knowledge exchange among them. \n“Business and BO registers are essential instruments for governments and businesses to implement functionning and effective AML frameworks. Registries are confronted to increased complexities in operating their registers and need to adapt their business operating model continuously in a fast-evolving environment of international standards\, technological advancements\, increased stakeholder expectations\, data quality and enhanced interoperability” stated Yves Gonner\, Director of the Luxembourg Register\, while highlighting the relevance of this week’s workshop in bringing together jurisdictions of various backgrounds\, context and BO registration models. \nA number of key topics were covered during the training\, including technical implementation of the Financial Action Task Force (FATF) Recommendations 24 and 25\, the role of analysis and cooperation in ensuring access to adequate and accurate beneficial ownership information\, as well as enforcement and sanctioning mechanisms. \nThe event featured contributions from distinguished experts from financial intelligence units and beneficial ownership registers who shared first hand insights gained from their experiences in implementing beneficial ownership frameworks in their respective jurisdictions. In addition to panel discussions and presentations\, the activity incorporated group exercises\, case studies and dedicated sessions on the challenges and possible solutions to address risks related to complex and cross border structures. These threats encompass national and transnational organised crime\, drug trafficking\, money laundering\, public and private corruption\, terrorism\, and the proliferation of weapons of mass destruction. This dynamic necessitates a more rigorous\, technically advanced\, and coordinated approach among all domestic and international institutions involved in the criminal justice system.” \nMinister Llanes further elaborated\, stating\, “Our objective is to continue enhancing the capacity of law enforcement agencies to further bolster the ongoing intensive monitoring efforts within our nation. We aim to achieve more substantial outcomes\, particularly in the context of result 7\, pertaining to the investigation and prosecution of money laundering\,” as highlighted by Minister Liliana Alcaraz Recalde of Seprelad. \n“The generous support from the EU’s Global Facility enables us to transform intelligence into actionable evidence\, aligning with the overarching theme set forth by this international organisation during the inaugural collaborative training initiative between Seprelad and Senaclaft\,” affirmed the highest-ranking authority. \nCollaboration and information exchange among institutions involved in AML/CFT efforts are crucial for success. However\, these processes have been identified as problematic not only among regulators and law enforcement agencies but also between the public and private sectors. As a response\, the EU Global Facility designed the “Turning Intelligence into Evidence” workshop series. \nEU Head of the Political Section of the EU Delegation to Paraguay\, Fredrik Sterner\, highlighted the importance of cooperation in order to address this challenge\, commending the work conducted by the EU Global Facility in this regard. \n“ It is unthinkable to talk about prevention or repression of money laundering\, working in isolation and without international cooperation. But coordination must also be regional in scope\, in order to be able to confront the large criminal organisations that attack our region with such harmful scourges as drug trafficking\, organised crime and\, as a consequence\, money laundering\,” stated Maria Noel Cabillon\, legal adviser at the SENACLAFT in her opening speech. \nSpeaking on behalf of the Uruguayan authorities\, she highlighted: “Uruguay\, like many other regional countries\, faces a shortage of money laundering convictions\, necessitating comprehensive work throughout the process\, from information gathering to evidence evaluation in court. These sessions are of paramount importance\, bringing together 15 representatives from 8 organisations in Uruguay to share their expertise\, acquire new knowledge\, and foster the much-needed coordination and inter-institutional collaboration within our system.” \nAs of September 2023\, the course has been delivered to partners in Jordan\, Panama\, Seychelles\, Turkiye and the UAE. This mission follows online training delivered following the request for technical assistance made by the authorities of Malawi to the European Commission in the spring of 2023. \nToday\, the team starts with a hybrid workshop on the FATF Rec 8\, aimed at enhancing the capacities of Malawian authorities and Non-Profit Organisations (NPOs) in understanding and implementing the Financial Action Task Force (FATF)‘s said Recommendation 8. More specifically\, it seeks to provide insightful contributions to the Working Group responsible for the development of Malawi’s NPO Sectoral Risk Assessment in order to improve their capacity to assess and mitigate risks within the Non-Profit sector. \nOver the next few days\, the team\, led by David Hotte and Key Expert on Justice/CSO Mamuka Jgenti will carry out a scoping exercise with various state institutions of Malawi. These discussions\, coordinated by the EU Delegation in Lilongwe\, aim to ensure alignment with the priorities and needs formulated by Malawi on AML/CFT. \n🇪🇺 🇲🇼 We wish to extend our special thanks to the EU Delegation to Malawi for their support in organising this successful event and giving the EU Global Facility the best conditions to provide technical assistance to our partners.[/vc_column_text][/vc_column][/vc_row]
