This training will focus on the implementation of the FATF Recommendation 8\, the full engagement required by countries and thus the awareness of the issue by local NPOs. \nThis constitutes the first in a series of capacity building activities for the CSOs in the Seychelles. This series will carry an introductory objective\, including to prepare the country’s NPO community for the follow up measures to be taken within the framework of the EU Global Facility’s assistance to the Seychelles under its CSO component. \n“I am very happy to see our technical assistance starting only three weeks after our first mission there\,” said EU Global Facility Team Leader David Hotte in his welcoming remarks\, adding “these are only the first activities and we are sure I will mark the start of a great cooperation\, with many more activities to come.” \nThis session comes following the productive scoping mission our team conducted last month\, where a workplan of the EU GF’s engagement with the Seychelles was elaborated in co-ordination with the authorities of Seychelles. The workplan covers various AML/CFT topics on which the GFT shall focus in its engagement with the partners state. The GFT shall also remain in touch with the other TA providers to ensure the synergies in joint efforts. \n[/vc_column_text][/vc_column][/vc_row]

[…]\nThe hallmark in the evolution of the Bank of Mauritius has been its institutional strength\, and I can confidently affirm that the measures have reaped the expected results and the banking system has successfully weathered the crisis unscathed.” \nA reality that David Hotte focused on during his presentation on “AML/CFT Developments”\, stressing the need for “tailor-made and context-adapted regulatory and legislative changes in the banking sector.” \n“AML/CFT is an ever evolving matter and countries from all over the world need to be constantly on the lookout for new threats to their frameworks. This is why the EU Global Facility is so strongly committed to promoting a South to South technical assistance where experts trained by the EU GF can subsequently become trainers for their peers and colleagues from other countries of their region (and elsewhere).” \nAs part of its technical assistance to the partner country of Mauritius\, the EU Global Facility provided continuous technical assistance through various training and activities from June 2019 to May 2022. \n💡Mauritius was officially removed from the list of high-risk third countries with regards to anti-money laundering and counter-terrorist financing (AML/CFT) by the FATF[/vc_column_text][/vc_column][/vc_row]

She emphasised the need for enhanced cooperation and shared BO Information related to financial and economic crimes\, encouraging countries to “build systems and learn about what other countries are doing  to change legislation\, how they maintain accurate and update BO information and how this information should be shared with stakeholders  in the value chain of AML/CFT regime.” \nFor his part\, EU Global Facility Team Leader David Hotte\, welcomed the participation of representatives from 18 countries\, saying “it is particularly impressive to witness the attendance of so many countries\, which shows African nations’ committment to the enhancement of beneficial ownership frameworks within their respective jurisdictions. I am confident that these three days of exchanges will yield great results with regards to transparency of legal persons and legal arrangements.” \nThe workshop\, which will consist of interactive exchanges and thematic presentations\, will allow participants to exchange best practices and further deepen their expertise on BO-related matters. \n“Due to the current challenges faced by countries in understanding the issues of BO\, the ESAAMLG is having 18 of its member countries participate in this important event aimed at building more awareness on how countries can comply with the Financial Action Task Force’s standards on BO and how to implement relevant measures. Our Secretariat is confident that the workshop will go a long way in assisting members to come up with effective systems to handle BO\,” stated Expert Joseph Jagada from the ESAAMLG secretariat. \nThe conference is part of a series of technical assistance activities delivered by the EU GF-AML/CFT to third countries around the world. Demand driven and tailored made\, the support is provided on a bilateral\, regional and thematic basis. Almengor highlighted that the presentation of the Guide is generated as part of the implementation of Law No. 129 of March 17\, 2020\, which creates the Single Private System for the Registry of Final Beneficiaries of Legal Entities and its regulatory Decrees. \nVice-Minister Gordón emphasized that “(The) initiatives such as this Guide\, are part of the fundamental building blocks of the regulatory and operational reforms which allow us to guarantee the integrity and transparency of all legal persons and arrangements throughout the country\, in accordance with the international standards which we have committed to ». \nFor its part\, the SSNF underlined the importance of the work undertaken by Panama and SSNF over the last few years to achieve delisting from the FATF list. “It has involved the establishment of a legal framework in line with international standards\, but also the development of tools to assist the private sector and resident agents in their work of identifying\, verifying and registering beneficial owners\,” explained Dayra Carrizo\, Superintendent of SSNF. \nShe added: “The effectiveness of the mechanisms put in place in Panama depends on the commitment of all stakeholders\, and noted the importance resident agents are playing in the institutional set-up of Panama for which they are a key component. These workshops aimed to strengthen the basis for coordination between these stakeholders which commitment is paramount for Panama to be able to demonstrate the effectiveness of the measures taken to ensure the availability and accessibility of BO information in Panama.” \nOver the course of four days\, more than 500 participants attended the training onsite and online. \n“This demonstrate the huge interest and commitment in the subject matter\, and is the materialisation of the efforts undertaken by Panama with regards to its compliance with the Financial Action Task Force’s (FATF) requirements related to transparency of legal persons and arrangements\, amongst the most challenging FATF Recommendation\, and one for which the effectiveness of the measures taken is likewise most difficult to establish and demonstrate\,” stated Alexandre Taymans\, Key Expert on Beneficial Ownership for the EU Global Facility. \nExperts from the SSNF and the Global Facility delivered sessions covering a wide range of topics including the FATF and EU standards\, the newly published SSNF’s Beneficial Ownership Guidance\, the practical functioning of the Panamanian BOR\, the role and strategy of the SSNF to guarantee compliance with the Beneficial Ownership identification and registration requirements. The sessions also included various case studies and examples that fostered discussion between participants on how\, in practice\, beneficial owners should be identified and their information verified. Since Panama considered tax offenses as a predicate offense of ML in 2019\, various investigations have been initiated\, generated either by the use of UAF products\, international cooperation\, the Task Force or by the Public Ministry based on the Action Protocol. This reflects the good inter-institutional coordination and effectiveness of our system.” \nThe training is part of a series of activities organised by the EU Global Facility to support Panama in strengthening its AML/CFT frameworks and upholding its compliance standards in this regard. More specifically\, the technical assistance focuses on Panama’s fulfilment of the immediate results 5 and 7 of the Financial Action Task Force as adapted to the needs and priorities established by Panama. \n “Organised crime and terrorism threaten our peaceful coexistence and it is on the basis of national and international collaboration that we must combat illicit movements of capital under a clear and joint vision\, based on the experience of the international organisations that promote a state of welfare and justice\,” said Adolfo Campos\, Charge d’Affaires a.i. of the EU Delegation to Malta was represented by Dr Geraldine Spiteri Lucas from the MBR and Mr Alfred Zammit from the FIAU. \n“Our ultimate goal is to ‘handbook’ tangible proposals and best practices that can be made available to stakeholders and jurisdictions who are seeking to build or enhance national beneficial ownership capabilities\,” explained EU Global Facility Key Expert on Beneficial Ownership Alexandre Taymans\, noting that “the purpose of these sessions is to delve deeper into the topic\, discuss challenges and lessons that can be learnt and applied for technical assistance to the benefit of the EU GF partner countries. This way we can put forward an approach for more effective national and cross border beneficial ownership disclosure frameworks.” \nFor her part Dr Geraldine Spiteri Lucas\, MBR Chief Executive Officer\, explained Malta’s experience in arriving where it is today\, which is having an accurate and an up-to-date Beneficial Ownership Register. ‘The effectiveness of the BO Register revolved around accuracy and accessibility by competent authorities and subject persons. Most importantly\, it is crucial to have all the entities work together hand in hand. It is indeed of great pleasure for Malta to have welcomed representatives from registries across Europe discussing a subject that is dominating amongst registers fora’ said Dr. Spiteri Lucas. \nAlfred Zammit\, Deputy Director at the Financial Intelligence Unit of Malta\, explained that Beneficial Ownership registries are becoming an increasingly important component in the fight against ML/FT\, but transitioning from a registry to a competent authority is easier said than done. Sharing best practice and exploring different forms of cooperation\, including with FIUs and other authorities\, is therefore very-much needed and a step that we and the community all stand to gain from. \nSupport to partner countries’ Beneficial Ownership frameworks is a key pillar of the EU Global Facility on AML/CFT’s work around the globe. So far\, the project has assisted more than 11 jurisdictions in Africa\, Asia\, Latin America and Europe at a bilateral level. A number of regional conferences was also organised to enhance international cooperation in this regard.[/vc_column_text][divider line_type=”No Line” custom_height=”60px”][/vc_column][/vc_row][vc_row type=”in_container” full_screen_row_position=”middle” column_margin=”default” column_direction=”default” column_direction_tablet=”default” column_direction_phone=”default” scene_position=”center” text_color=”dark” text_align=”left” row_border_radius=”none” row_border_radius_applies=”bg” overflow=”visible” overlay_strength=”0.3″ gradient_direction=”left_to_right” shape_divider_position=”bottom” bg_image_animation=”none”][vc_column column_padding=”no-extra-padding” column_padding_tablet=”inherit” column_padding_phone=”inherit” column_padding_position=”all” column_element_spacing=”default” background_color_opacity=”1″ background_hover_color_opacity=”1″ column_shadow=”none” column_border_radius=”none” column_link_target=”_self” column_position=”default” gradient_direction=”left_to_right” overlay_strength=”0.3″ width=”1/2″ tablet_width_inherit=”default” tablet_text_alignment=”default” phone_text_alignment=”default” animation_type=”default” bg_image_animation=”none” border_type=”simple” column_border_width=”none” column_border_style=”solid”][vc_gallery type=”flexslider_style” images=”4260\,4261\,4262\,4263\,4264\,4265″ onclick=”link_no”][/vc_column][vc_column column_padding=”no-extra-padding” column_padding_tablet=”inherit” column_padding_phone=”inherit” column_padding_position=”all” column_element_spacing=”default” background_color_opacity=”1″ background_hover_color_opacity=”1″ column_shadow=”none” column_border_radius=”none” column_link_target=”_self” column_position=”default” gradient_direction=”left_to_right” overlay_strength=”0.3″ width=”1/2″ tablet_width_inherit=”default” tablet_text_alignment=”default” phone_text_alignment=”default” animation_type=”default” bg_image_animation=”none” border_type=”simple” column_border_width=”none” column_border_style=”solid”][divider line_type=”No Line” custom_height=”120px”][nectar_cta btn_style=”see-through” heading_tag=”h4″ button_color=”default” button_border_thickness=”0px” link_type=”regular” alignment=”center” alignment_tablet=”default” alignment_phone=”default” display=”block” display_tablet=”inherit” display_phone=”inherit” link_text=”See more photos” url=”https://www.global-amlcft.eu/images-videos/”][/vc_column][/vc_row]

In this way\, it will defend itself against the influence of organised crime on its institutions and can protect the interests of the state and the nation.” \nThe regional event aims to allow participants to exchange and further their expertise on FATF standards on availability and accessibility of beneficial ownership information\, the assessment of money laundering and terrorism financing risks associated with the misuse of legal persons and arrangements in the GAFILAT region\, the design and implementation of mitigation measures as well as emerging trends and specific topics related to the ever increasing importance of beneficial ownership transparency throughout jurisdictions across the world. \nIn his welcoming remarks\, EU GF Team Leader David Hotte\, thanked the GAFILAT and Panamanian authorities for their support\, noting: “we are particularly happy to see such a high level of attendance in this first regional conference the EU Global Facility is organising in Latin America. Panama has been a trusted partner country of the project\, where we have delivered 10 activities since our first mission back in October 2021.” \n“Support to partner countries’ Beneficial Ownership frameworks is a key pillar of the EU GF’s work around the globe. So far\, we have assisted more than 11 jurisdictions in Africa\, Asia\, Latin America and Europe on BO at a bilateral level while reaching almost 70 countries through regional conferences.” \nFor his part\, Executive Director of GAFILAT\, Esteban Fullin\, stated: “making Beneficial Ownership information available is key to having a successful AML/CFT system\, GAFILAT is committed to mitigate any possible misuse of corporate vehicles to allow money launderers and criminal organisations to profit their illicit gains. The second iteration is foreseen in South East Asia in the beginning of 2023.[/vc_column_text][/vc_column][/vc_row]

The EU Global Facility will therefore continue its ongoing work in this domain.” \nOur Key Expert on Beneficial Ownership Alexandre Taymans\, described the work being carried by the project with partner countries and organisations\, which includes bringing together experts from the public and private sector\, as well as civil society representatives. He emphasised that “the composition of the panel and the wide range of expertise put together today\, is a reflection of the multi-stakeholder engagement and enforcement strategies that will inevitably be required for BO disclosure systems to be made effective”. \nHe discussed the follow-up work to be conducted in this domain\, which will involve discussing measures to address and reduce the risk of complexity affecting beneficial ownership transparency.[/vc_column_text][/vc_column][/vc_row]
