The #EU and its Member States have gone a long way fighting these crimes. A number of stakeholders from the AMLU\, the Central Bank of Jordan and the Companies Control Department along with competent authorities have worked together on designing and implementing the assessment of the AML/CFT risks and the misuse of legal persons and legal arrangements\, using a leading-edge methodology. \n  \nIn her opening remarks\, Head of the Anti-Money Laundering Unit of Jordan\, Samya Abu Sharif\, noted: “the topic of today’s workshop is an indication of the important role of all national agencies in promoting the necessary actions to combat the risks of money-laundering and terrorist financing associated with legal persons and legal arrangements at the national level.” \n“Understanding the potential threats\, and strengthening the system to achieve increased transparency for the legal persons and the legal arrangements and developing national programmes in partnership with the private sector to reduce their impact is a crucial objective of thjs assessment work.”  \n“The results of the assessment presented today will help us better understand and be directed towards high-risk aspects in order to prevent criminals from exploiting legal persons and legal arrangements in ML/TF crimes\,” she added. \nFor his part\, EU Global Facility Key Expert on Beneficial Ownership Alexandre Taymans commended the “successful work and important efforts put together by Jordan to conduct this exercise in such a structured and timely manner”. \n“As the dissemination of the findings of this assessment are now launched\, such a milestone calls for and paves the way for an enhanced engagement between competent authorities\, as well as with the private sector to ensure that the recommendations and the mitigating measures identified by the working group will be fully implemented before the next update to the risk assessment\,” he stated. \nThe EU Global Facility has developed a dedicated methodology for the risk assessment of legal persons and arrangements to assist partner jurisdictions with a methodology that can be tailored to their specific context. \nThis activity is a milestone for any country implementing a BO disclosure framework as it will help them identify the risk jurisdictions are facing from the misuse of legal vehicles both at national and international level. This risk assessment is also to be put in the context of the renewed and increasing focus the FATF’s new recommendation 24 (April 2022) has put on this challenging exercise for jurisdictions considering the scope of such exercise\, the number and variety of stakeholders involved and the level of technical expertise it requires.[/vc_column_text][/vc_column][/vc_row]

This will serve to discuss the specific features and mechanisms through which beneficial ownership information can be registered\, vetted and enforced. \nAdriana del Pilar Solano Cantor\, Deputy Director of the Tax Registry Administration in Colombia\, stated that “This workshop will enable Colombia to identify good practices for the deployment of such beneficial ownership registries\, the existing opportunities for improvement of the regulatory framework and IT system in Colombia and the development of new features in the registry such as the registration of the chain of ownership and control. Similarly\, this exchange of experience will also serve to identify areas of improvement in the technical framework”. \nFor his part Alexandre Taymans\, Key Expert of the EU Global Facility on Beneficial Ownership\, celebrated the launch of this first beneficial ownership training in Colombia. He noted the fact that Colombia already had an operational beneficial ownership registration system and good understanding of the issues that it will face\, both in terms of ensuring the availability\, quality and accessibility of the information\, which will ensure very fruitful discussions and exchanges. He also indicated that beyond the training and exchange of experiences\, this activity was also aimed at identifying areas of future cooperation in areas where the expertise of the Global Facility could be deployed to support Colombian authorities. \nOn Thursday\, other competent authorities from Colombia will attend a session focusing on international standards and best practices on the topic of Beneficial Ownership as well as the tools that can be developed to enhance the understanding of BO disclosure requirements. \nThe sessions will also cover the verification and supervision mechanisms that can be implemented by jurisdictions to ensure that frameworks are effectively implemented by both private and public sector stakeholders.[/vc_column_text][/vc_column][/vc_row]

The team was accompanied by the Ambassador of the European Union in Paraguay\, Javier García de Viedma. \nThe discussions revolved around the the key priority actions identified in the Mutual Evaluation Report of the Republic of Paraguay approved in 2022 by the GAFILAT\, which reflects the needs of the country in AML/CFT. \nLater on\, the EU Global Facility experts met with the First Vice President\, @Carolina Llanes\, and Justices Luis María Benítez Riera and Alberto Martínez Simón at the Supreme Court of Justice. \nTechnical discussions were then led with representatives of the law enforcement agencies in charge of investigating financial crimes\, namely SENAD\, SENAC\, the National Police\, Customs and SEPRINTE. \nOn the last day\, a meeting with judges and prosecutors specialised on AML/CFT was held\, where the attendees discussed the main findings of the Evaluation and the mechanisms to be implemented to implement the necessary structural improvements to the systems of investigation\, prosecution and conviction of AML/CFT crimes.[/vc_column_text][/vc_column][/vc_row]

They will enable the Congolese authorities to better understand the scope of CFS obligations and their place in the strategy to combat the financing of terrorism and the financing of nuclear proliferation. The analysis of the law and the training sessions will be used to fuel subsequent exchanges on the operationalisation of the adopted texts. \nThree main areas of work are proposed:\n1. Operationalisation of the institutional framework dedicated to the CFS: support for the definition of operational processes for the implementation of Recommendations 6 and 7 (identification of targets\, communication of lists\, withdrawal of lists\, unfreezing of funds\, etc.)\n2. Establishment of processes for monitoring and inventorying frozen assets\, to enable the DRC to respond to the FATF’s request for statistics on frozen assets (develop the process for communicating frozen assets to the competent authorities and their centralisation)\n3. Ensure effective implementation of targeted financial sanctions by raising awareness of the scope of the obligations among the authorities responsible for monitoring the implementation of the CFS and the private sector”. \nOn Tuesday 25 April\, the EU Global Facility team will provide a mentoring on national coordination\, aimed at preparing the Technical Assistance Coordination Committee (TACC) meeting foreseen at the EU Delegation on Wednesday 26 April. \nThe TACC was launched last December in Kinshasa\, in order to best coordinate the work of all technical assistance providers to the Congolese partners in their efforts to strengthen their AML/CFT frameworks.[/vc_column_text][/vc_column][/vc_row]

the fight against money laundering and terrorist financing and guarantor of the transparency of economic transactions necessary for economic growth\,” said the Director General of the register\, Adel Chouari\, at the opening of the training on Tuesday. \nHe stressed the importance of the implementation of a register of beneficial owners\, which is the first guarantor of transparency and integrity of the financial sector\, especially since Tunisia is preparing to come under the scrutiny of the Financial Action Task Force (FATF) in 2024\, for a periodic evaluation. \nFor his part\, the Head of Section and First Secretary of the Delegation of the European Union in Tunisia\, Massimiliano Messi\, noted that the EU will always support the NER and Tunisia so that investment remains viable and It also aims to raise awareness of this phenomenon among all stakeholders in order to reduce and counter money laundering and terrorist financing (ML/TF) in these lucrative markets and protect a country’s heritage. \nThe three-day regional event opened at Mexico’s National Museum of Anthropology with 120 high-level participants from Latin America and the Caribbean\, the European Union and international organisations such as UNESCO\, Interpol and the World Customs Organization\, among others. \nDuring her participation\, the Minister of Culture\, Alejandra Frausto Guerrero\, stressed the importance of inter-institutional collaboration to stop the trafficking of heritage assets\, and offered her support to advance this objective. “We are talking not only about a legal issue\, but also about a human rights issue. Culture is based on cultural rights\, on the rights to identity\, on the rights of those peoples and communities that have historically been plundered by decades of plundering\, of marginalisation\, and are those places where the greatest cultural wealth is preserved”. \nThe head of the country’s cultural policy commented on the actions that have been put in place\, for example\, the Inter-institutional Commission of the Mexican Government to work on the issue and seek the repatriation of pieces that are outside the country\, as well as the campaign #MiPatrimonioNoSeVende\, to stop auctions that occur outside the national territory\, which has allowed the return to Mexico of more than 11\,500 pieces. \nThe Head of the Financial Intelligence Unit\, Pablo Gómez Álvarez\, referred to the strategic role of the Financial Intelligence Unit in the identification and tracking of illicit trafficking of cultural property in Mexico related to money laundering. There are risks associated with these markets and many countries do not have sufficient understanding of these risks.”  \n“Criminals seek to exploit the sector’s history of privacy\, which\, coupled with a lack of awareness\, results in a lack of resources\, expertise and experience to investigate and prosecute these crimes both domestically and internationally\,” he pointed out. He acknowledged that the issue of art trafficking and money laundering has been little explored\, when it is a threat\, a precedent crime that generates illicit profits\, hence the importance of the regional conference. “That’s also why I think we can learn a little bit from what the Mexican Ministry of Culture and the Mexican FIU can bring to us\,” she said.\n \nIn his welcome address\, David Ultimately\, the Senior Advisory Group shall provide substantive inputs on how to increase the efficiency of the EU Global Facility in assisting states (i) to comply with the international standards on AML/CFT and; (ii) to support the national Financial Intelligence Units\, judiciary and law enforcement agencies to implement the international instruments’ provisions as well as the Financial Action Task Force (FATF) Recommendations. \nOn the second day\, participants discussed the EU response on AML/CFT\, through a review of the European Commission’s Architecture on AML/CFT Technical Assistance and the perspectives ahead. \nModerated by de Kerchove Gilles \, the discussions also covered the new EU AML Package (https://lnkd.in/eYZavjGZ)\, shedding a specific light on the creation of the AMLA and on the evolution of the listing process for high-risk third countries. \n“The AMLA was thought through in very close collaboration with national Financial Intelligence Units\, as it is not destined to replace these national layers. These sessions aim to empower the Botswanan authorities with the knowledge and tools necessary to conduct a National Risk Assessment (NRA) aligned with Rec 15. \nThe first three sessions\, conducted between April and May\, have now set a solid foundation for the NRA process. They covered key aspects such as the structure of the NRA for Virtual Assets (VA) and VASPs\, the use of analytical tools for risk-based supervision\, and the conduct of a questionnaire-based assessment.\n👏🏽👏🏽👏🏽 These sessions enabled us to better understand and analyse the responses received\, ensuring a robust and comprehensive NRA. \nIn the recently concluded fourth session\, our experts delved into the crucial understanding of VA features and VASP operations. Focus was on comprehending the unique characteristics of VAs\, their potential attractiveness for money laundering and terrorist financing\, as well as gaining insights into VASP operations. \n👏🏽👏🏽👏🏽This knowledge will help Botswana develop effective strategies to mitigate risks associated with these emerging technologies. \n💡 The collaboration between the EU GF and Botswana exemplifies the power of international cooperation in combating financial crimes and ensuring the integrity of the global financial system. These informative sessions delved into the world of AMLCFT for gaming\, covering crucial topics such as requirements\, typologies\, supervision\, risk assessment\, and coordination with other competent authorities like the FIU and/or the LEAs. This aligns perfectly with the actions emphasised in the FATF Post Observation Progress report. \n  \n💼 Today\, on May 19th\, we launched Session 3 on IO 3/Supervision\, going in-depth on the following crucial aspects: \n\n1️⃣ Identifying clients: Understanding the importance of accurately identifying clients within the gaming sector.\n2️⃣ Verifying information: Emphasising the significance of verifying client information to ensure transparency and accountability.\n3️⃣ Recording data: Highlighting the need to maintain proper records of all relevant information.\n4️⃣ Detecting suspicious transactions: Equipping participants with the skills to identify suspicious transactions within the gaming industry.\n5️⃣ Disseminating suspicious transactions to the FIU: Establishing effective channels for promptly reporting any suspicious activity to the Financial Intelligence Unit.\n\n  \nWe extend our sincere congratulations and gratitude to the gaming authority in Mozambique for their strong engagement and commitment towards enhancing AML/CFT practices in the country. \nSpecial thanks and recognition also to Paulo Lopes\, Gaming Authority in Portugal\, for his invaluable contributions and support in this endeavour.[/vc_column_text][/vc_column][/vc_row]

Together\, we explored the implications of the FATF’s updated Recommendation 24 and its impact on the EU GF’s work with partner countries. \n2️⃣ Mr Stien also shared insights and expertise on using assessments made by other international bodies in the context of the EU GF’s work with partner countries. The EU GF firmly believes in leveraging existing assessments to strengthen the implementation of effective measures. \n3️⃣ Our Expert provided valuable guidance on the priorities countries should focus on when implementing a sustainable Beneficial Ownership (BO) framework. The importance of early engagement\, high-level and operational commitment\, strong public-private partnerships\, and forward-looking implementation measures were emphasised. \n4️⃣ The EU GF was invited to partake in the Technical Assistance and Training Working Group (TATWG) where Mr Stien presented a comprehensive overview of the activities conducted with MENA countries since 2020. \n“We are proud to have trained over 3\,000 individuals during almost 100 different activities. In addition to bilateral activities conducted with partner countries such as Algeria\, Jordan\, Morocco\, Tunisia\, and the UAE\, we have also organised numerous regional events to foster knowledge sharing and collaboration\,” he stated. \n📅 Upcoming events include: “Strengthening Judicial Cooperation in the MENA Region: Integrated Approaches to the Investigation and Prosecution of Money Laundering” in Rabat\, 5th-7th June 2023. \nWe are humbled to have received a “Certificate of Appreciation” from MENAFATF Executive Secretary Suliman Al Jabrin\, who recognised the project’s significant contributions to the group’s activities in 2022. Launched in March 2023 in Buenos Aires for the GAFILAT and CFATF regions\, the activity was replicated in Warsaw for the MONEYVAL region a month later.
