More specifically it will review how legal professions and accountants\, and their self-regulated bodies\, adequately apply AML/CFT preventive measures commensurate with their risks\, and report suspicious transactions. \nIn the second day\, a technical training for ML/TF self-regulated bodies will be delivered. Almengor highlighted that the presentation of the Guide is generated as part of the implementation of Law No. 129 of March 17\, 2020\, which creates the Single Private System for the Registry of Final Beneficiaries of Legal Entities and its regulatory Decrees. \nVice-Minister Gordón emphasized that “(The) initiatives such as this Guide\, are part of the fundamental building blocks of the regulatory and operational reforms which allow us to guarantee the integrity and transparency of all legal persons and arrangements throughout the country\, in accordance with the international standards which we have committed to ». \nFor its part\, the SSNF underlined the importance of the work undertaken by Panama and SSNF over the last few years to achieve delisting from the FATF list. “It has involved the establishment of a legal framework in line with international standards\, but also the development of tools to assist the private sector and resident agents in their work of identifying\, verifying and registering beneficial owners\,” explained Dayra Carrizo\, Superintendent of SSNF.  \nShe added: “The effectiveness of the mechanisms put in place in Panama depends on the commitment of all stakeholders\, and noted the importance resident agents are playing in the institutional set-up of Panama for which they are a key component. She emphasised the need for enhanced cooperation and shared BO Information related to financial and economic crimes\, encouraging countries to “build systems and learn about what other countries are doing  to change legislation\, how they maintain accurate and update BO information and how this information should be shared with stakeholders  in the value chain of AML/CFT regime.” \nFor his part\, EU Global Facility Team Leader David Hotte\, welcomed the participation of representatives from 18 countries\, saying “it is particularly impressive to witness the attendance of so many countries\, which shows African nations’ committment to the enhancement of beneficial ownership frameworks within their respective jurisdictions. I am confident that these three days of exchanges will yield great results with regards to transparency of legal persons and legal arrangements.” \nThe workshop\, which will consist of interactive exchanges and thematic presentations\, will allow participants to exchange best practices and further deepen their expertise on BO-related matters. \n“Due to the current challenges faced by countries in understanding the issues of BO\, the ESAAMLG is having 18 of its member countries participate in this important event aimed at building more awareness on how countries can comply with the Financial Action Task Force’s standards on BO and how to implement relevant measures. Our Secretariat is confident that the workshop will go a long way in assisting members to come up with effective systems to handle BO\,” stated Expert Joseph Jagada from the ESAAMLG secretariat. \nThe conference is part of a series of technical assistance activities delivered by the EU GF-AML/CFT to third countries around the world. Demand driven and tailored made\, the support is provided on a bilateral\, regional and thematic basis. As of September 2022\, the project has delivered bilateral assistance to 16 countries globally. \n  \n—- \nThe regional workshop “Enhancing Effectiveness of Beneficial Ownership Frameworks: Evolving Technical Standard and their Effective Implementation” will take place in a hybrid format (onsite and online) on 13-15 September 2022 in Lusaka\, Zambia. \nThe regional event is co-organised by the EU Global Facility on AML/CFT\, the ESAAMLG Secretariat and the Financial Intelligence Centre of the Republic of Zambia (FIC). \nThe workshop has been designed to allow participants to exchange and further their expertise in the following areas : \n\nThe FATF and EU standards related to beneficial ownership and the transparency of legal persons (LP) and legal arrangements (LA)\,\nThe importance of country-wide assessments of the ML/TF risks associated with LP/LA as well\, the methodology developed by the Global Facility and case studies presented by Ghana\, Mauritius and the United Kingdom\,\nThe role (public) beneficial ownership registers is expected to play in future AML/CFT frameworks\, the Global Facility’s methodology for their implementation as well as country case studies\,\nThe role of FI/DNFBP in ensuring the availability and accessibility of beneficial ownership information within a jurisdiction\,\nThe practical tools and solutions available to supervisors to design and implement risk-based supervision strategies on beneficial ownership identification/verification obligations\,\nThe practical considerations and concrete actions a jurisdiction can take The meeting was followed by the 5th ESSAAMLG AML/CFT Public-Private sector dialogue (PPSD) on virtual assets and the implementation of AML/CFT programmes in the ESSAMLG region. \nOn the Agenda for the EU Global Facility: \n\n✔︎ Participation in the Technical Assistance Coordination Forum where the bilateral and regional activities conducted by the EU GF in the region will be discussed in addition to forthcoming events.\n✔︎Liaison with the delegations from partner countries with which the EU GF is already engaged.\n✔︎ The EUGF will also follow up on the work achieved by the ESAAMLG\, such as the publication of the regional survey on de-risking/correspondent banking\, which was the topic of the regional conference organised by the EUGF in May 2022 in Mauritius.\n\nThe EU Global Facility is pleased to note that a number of TA activities implemented in partner states -as well as upcoming ones- have been reflected in the documents adopted by the ESAAMLG. Notably\, support was requested for the accountancy professions (chartered accountants and certified accountants)\, the legal professions (lawyers\, notaries\, adouls)\, dealers in precious stones and metals and traders in antiques or works of art\, casinos and gambling establishments\, as well as real estate agents. \nThe EU Global Facility began delivering online technical assistance activities to Morocco in November 2020\, focusing on the topics on beneficial ownership and cryptocurrencies. The purpose of the event was to delve deeper into the topic\, discuss challenges and lessons learnt and put forward an approach for more effective national and cross border beneficial ownership disclosure frameworks.\nThe session involved only a small number of participants from Beneficial Ownership Registers and FIUs\, creating an opportunity to meet\, network and exchange ideas with colleagues on a very topical matter. \n  \nIn their words:\nAlfred Zammit\, Deputy Director at the Financial Intelligence Unit of Malta\, reflects on the activity: \n“It was a pleasure for me to be able to contribute to the interesting discussions that we had in Brussels\, and to share Malta’s experiences and best practices on the topic of beneficial ownership\,” he stated after the workshop. \n“It was also interesting and useful to hear about the experiences\, practices and challenges faced by our international colleagues from FIUs and BO registries\, possible solutions\, and above all\, the different approaches implemented on the ground. This new guidance will assist these reporting entities to identify the beneficial owners of legal persons and legal arrangements in compliance with the requirements of the customer due diligence measures they are required to conduct. \nThese sessions\, held in Amman\, were delivered by international experts from the EU Global Facility and covered topics such as how criminals misuse corporate entities to commit financial crime\, the FATF and EU beneficial ownership disclosure standards\, and approaches and operational considerations relating to identifying of red flags of corporate entities misuse as part of regulatory authorisations and ongoing supervision. Practical case studies were also discussed with the participants. \nThe Central Bank of Jordan team also presented the new guidance on BO transparency and encouraged the audience to provide feedback on the content so has to complement it prior to its publication. \nDeputy Chief of the Anti-Money Laundering and Counter Terrorist Financing Unit of Jordan\, Ala’ Bani Fawaz\, stressed the importance of identifying the BO from corporate entities in order to prevent their misuse in committing financial crimes\, money laundering and terrorist financing. \nHe also presented key points of the guidance that will be officially issued soon\, which contains useful practical examples and guidance for the entities on how to identify the ultimate beneficial ownership within legal structures. \nM. I am confident that the discussions at this conference will provide guidance in this direction.” \nThe high level conference will witness the participation of representatives from some of the most important actors in the banking field\, including the International Monetary Fund\, the Wolfsberg Group\, SWIFT\, the Financial Action Task Force (FATF)\, the Egmont Group\, Facebook Payments\, as well as Mauritian financial institutions. \n“The BoM works very closely with all its regulatees to ensure a continuous monitoring of developments on the front of correspondent banking and cross border payments. This workshop is therefore of paramount importance to come out better equipped in view of fostering stronger correspondent banking relationships\,” said Harvesh Seegoolam\, Governor of the BoM. \nFor his part\, David Hotte\, Team Leader of the EU Global Facility\, explained: “The economic impact of de-risking can be devastating for countries around the world. These activities seek to lead to the production of a far-reaching study on existing good practice that alleviate the burden of proof in ML investigations and asset recovery procedures. The results of the study shall provide a valuable resource for the work of relevant global and regional institutions (e.g. FATF\, FSRBs\, EU and UN relevant structures etc.)\, as well as national authorities and justice sectors. \nGeneral Prosecutor of Romania Gabriela Scutea opened the session on Monday\, stating “We need  to help develop new innovative instruments to combat ML and terrorist financing (TF) worldwide. I am trusting that the result of this collaborative work will be helpful and inspire legal practitioners not only here in Romania but also in many countries of the world.” \nFor his part\, EU Global Facility Team Leader David Hotte noted in his opening remarks: “Today\, we need to find a solution to combat ML/TF in an ever more efficient way that is useful for all but also constitutional and in respect of human rights.” \nDuring this specific session\, experts worked to identify\, in their domestic law\, one or several legal mechanisms (legislative provision\, rule established by consolidated case law\, administrative mechanism\, etc.) which facilitate satisfying the reversed burden of proof in ML and cases of illicit enrichment offence. \nPresident of the Siracusa Institute\, Jean-François Thony\, stressed the importance of the matter\, saying “the experts meeting today have one question to answer: how can we improve the fight against money laundering and terrorist financing and how can we ensure that criminals engaging in that kind of activities can be sentenced and deprived of their ill-gotten assets\, within the respect of constitutional rights?”  \n“All practitioners know that the difficulty of providing evidence of the offence of money laundering is more acute than for any other crime\, because the essence of this offence is precisely to hide It is with pleasure that we see the level of dedication to judicial cooperation\, a topic at the heart of the fight against money laundering and terrorist financing\,” said EU Global Facility Team Leader David Hotte in his welcoming remarks. \n“It is particularly impressive to witness participants from so many countries committed to the deepening of collaborative measures to ensure the due recovery of proceeds from organised crime and terrorist activities\,” he added\, thanking the Kingdom of Bahrain and all representatives for their attendance.   \nFor his part\, Jean-François Thony\, President of the Siracusa Institute\, highlighted the importance of the event\, stating: ‘‘this conference is one-of its kind. Indeed\, seeing judges and prosecutors from so many countries gathered in one room to cooperate on AML/CFT is unique\, especially in this region. Too often we forget the importance of judges and prosecutors in the AML/CFT process but not today.” \n“International collaboration of this level is of particular importance for the Siracusa Institute\, which is at the forefront of the fight against organised crime in the Mediterranean and has made of the improvement of criminal justice systems one of its core missions.” \nThe conference is part of a series of activities organised by the EU GF-AML/CFT and the Siracusa Institute aimed at strengthening international judicial co-operation and the efficient application of existing MLA standards and international instruments by judges and prosecutors. \nIn a video message\, Regional Counsellor on counterterrorism and security at the EU Delegation to Bahrain\, Philippe Cormier\, stated “this conference is an illustration of the fast and strong development of our common ambition to develop and deepen judicial cooperation in the MENA region and work to facilitate judicial DESCRIPTION:[vc_row type=”in_container” full_screen_row_position=”middle” column_margin=”default” column_direction=”default” column_direction_tablet=”default” column_direction_phone=”default” scene_position=”center” text_color=”dark” text_align=”left” row_border_radius=”none” row_border_radius_applies=”bg” overlay_strength=”0.3″ gradient_direction=”left_to_right” shape_divider_position=”bottom” bg_image_animation=”none”][vc_column column_padding=”no-extra-padding” column_padding_tablet=”inherit” column_padding_phone=”inherit” column_padding_position=”all” column_element_spacing=”default” background_color_opacity=”1″ background_hover_color_opacity=”1″ column_shadow=”none” column_border_radius=”none” column_link_target=”_self” gradient_direction=”left_to_right” overlay_strength=”0.3″ width=”1/1″ tablet_width_inherit=”default” tablet_text_alignment=”default” phone_text_alignment=”default” bg_image_animation=”none” border_type=”simple” column_border_width=”none” column_border_style=”solid”][vc_column_text]The EU-funded AML/CFT Global Facility\, in collaboration with the Eastern and Southern Africa Anti-Money Laundering Group (ESAAMLG)\, the Global NPO Coalition on FATF and the Financial Intelligence Centre (FIC)\, South Africa will jointly organise a three-day regional workshop on “Implementation of Requirements of FATF Recommendation 8” for ESAAMLG member countries. \nScheduled on 7 to 9 March 2022 in in Johannesburg\, South Africa\, the regional workshop will seek to assist participants to: \n\n– Understand the requirements of FATF Recommendation 8 and what they need to do to strengthen their legislations\, institutional and operational frameworks such as policies and other terrorist financing mitigating measures.\n– Acquire knowledge and expertise so that they are able to identify those NPOs that fall within the FATF definition and those which are likely to be at the risk of TF abuse\, and to better understand how the NPOs can be abused for terrorist financing purposes;\n– Acquire knowledge and expertise which will enable them to apply targeted risk-based supervision or monitoring of those NPOs that are at risk of being abused; and\n– Understand how they can establish effective mechanisms to facilitate cooperation and coordination and information sharing amongst relevant competent authorities in order to take preventive or investigative action in a timely manner.\n\nThis Workshop will be organised and held in the spirit of enhancing member countries’ compliance with relevant FATF Standards. It will provide regulators of NPOs\, FIUs and NPO Associations with a platform to discuss and share insights on best practices and challenges which they face and methodologies that can be used to ensure compliance with the FATF requirements on NPOs. Such exchanges will contribute towards prioritisising the improvement of national legislation and policies that will promote accountability\, integrity and public confidence in the administration and management of NPOs. The Workshop will also assist member countries to implement respective FATF ICRG Action Plans or any other follow-up processes in relation to Recommendation 8.[/vc_column_text][/vc_column][/vc_row]
