Launched in March 2023 in Buenos Aires for the GAFILAT and CFATF regions\, the activity was replicated in Warsaw for the MONEYVAL region a month later. It also aims to raise awareness of this phenomenon among all stakeholders in order to reduce and counter money laundering and terrorist financing (ML/TF) in these lucrative markets and protect a country’s heritage. \nThe three-day regional event opened at Mexico’s National Museum of Anthropology with 120 high-level participants from Latin America and the Caribbean\, the European Union and international organisations such as UNESCO\, Interpol and the World Customs Organization\, among others. \nDuring her participation\, the Minister of Culture\, Alejandra Frausto Guerrero\, stressed the importance of inter-institutional collaboration to stop the trafficking of heritage assets\, and offered her support to advance this objective. “We are talking not only about a legal issue\, but also about a human rights issue. Culture is based on cultural rights\, on the rights to identity\, on the rights of those peoples and communities that have historically been plundered by decades of plundering\, of marginalisation\, and are those places where the greatest cultural wealth is preserved”. \nThe head of the country’s cultural policy commented on the actions that have been put in place\, for example\, the Inter-institutional Commission of the Mexican Government to work on the issue and seek the repatriation of pieces that are outside the country\, as well as the campaign #MiPatrimonioNoSeVende\, to stop auctions that occur outside the national territory\, which has allowed the return to Mexico of more than 11\,500 pieces. \nThe Head of the Financial Intelligence Unit\, Pablo Gómez Álvarez\, referred to the strategic role of the Financial Intelligence Unit in the identification and tracking of illicit trafficking of cultural property in Mexico related to money laundering. There are risks associated with these markets and many countries do not have sufficient understanding of these risks.”  \n“Criminals seek to exploit the sector’s history of privacy\, which\, coupled with a lack of awareness\, results in a lack of resources\, expertise and experience to investigate and prosecute these crimes both domestically and internationally\,” he pointed out. He acknowledged that the issue of art trafficking and money laundering has been little explored\, when it is a threat\, a precedent crime that generates illicit profits\, hence the importance of the regional conference. “That’s also why I think we can learn a little bit from what the Mexican Ministry of Culture and the Mexican FIU can bring to us\,” she said.\n \nIn his welcome address\, David Hotte\, Team Leader of the EU Global Facility\, highlighted the innovative nature of the conference series\, which “addresses the intrinsically complex issue of the looting and art trafficking Global Facility on AML/CFT on Thursday wrapped up a three-day regional training workshop on “Implementing a register of beneficial owners” in Tunis. \n“It is part of the mission of RNE as an actor in the fight against money laundering and terrorist financing and guarantor of the transparency of economic transactions necessary for economic growth\,” said the Director General of the register\, Adel Chouari\, at the opening of the training on Tuesday. \nHe stressed the importance of the implementation of a register of beneficial owners\, which is the first guarantor of transparency and integrity of the financial sector\, especially since Tunisia is preparing to come under the scrutiny of the Financial Action Task Force (FATF) in 2024\, for a periodic evaluation. \nFor his part\, the Head of Section and First Secretary of the Delegation of the European Union in Tunisia\, Massimiliano Messi\, noted that the EU will always support the NER and Tunisia so that investment remains viable and interesting and a source of job and wealth creation. \n“It is very important for the EU to train in the field of Beneficial Ownership\, noting that the recommendations of the intergovernmental body that oversees global trends in money laundering and terrorist financing “FATF” are very important but those on BO still remain the most complicated” he said. \nMessi estimated that the presence of Along with our workshop for NPOs organised in Istanbul\, the EU Global Facility is delivering a training for law enforcement officials in Ankara. \nHeld under the title “Recognising the nexus between Criminal and Terrorist networks and how they utilise profit from both legal and Illegal Activities”\, the training involves different actors from the penal chain including MASAK (Financial Intelligence Unit)\, Police\, Gendarmerie and the Judiciary. \nAlongside our Key Expert on Law Enforcement Liam Ennis\, two Irish experts will tackle topics related to terrorism in the financial context\, namely understanding structures of terrorist groups\, links between terrorist business models and crime and lone actor terrorism\, among others. \nThe activity will actively involve the participants\, who will be tasked with solving a fictitious case study related to terrorism\, crime and money laundering in a designated context. \nThis workshop is part of a series of technical assistance activities carried out by the EU Global Facility in Turkiye\, as agreed as part of the workplan designed with the Turkish authorities in 2022.[/vc_column_text][/vc_column][/vc_row]

Cross-functional events are crucial to tackling AML/CFT\, as they encompass numerous actors of the financial and investigation penal chain. \n“Without intelligence\, financial investigations cannot succeed. However\, it is crucial for the judiciary and law enforcement agencies to collaborate to turn this intelligence into evidence admissible in court. Malta was represented by Dr Geraldine Spiteri Lucas from the MBR and Mr Alfred Zammit from the FIAU. \n“Our ultimate goal is to ‘handbook’ tangible proposals and best practices that can be made available to stakeholders and jurisdictions who are seeking to build or enhance national beneficial ownership capabilities\,” explained EU Global Facility Key Expert on Beneficial Ownership Alexandre Taymans\, noting that “the purpose of these sessions is to delve deeper into the topic\, discuss challenges and lessons that can be learnt and applied for technical assistance to the benefit of the EU GF partner countries. This way we can put forward an approach for more effective national and cross border beneficial ownership disclosure frameworks.” \nFor her part Dr Geraldine Spiteri Lucas\, MBR Chief Executive Officer\, explained Malta’s experience in arriving where it is today\, which is having an accurate and an up-to-date Beneficial Ownership Register. ‘The effectiveness of the BO Register revolved around accuracy and accessibility by competent authorities and subject persons. Most importantly\, it is crucial to have all the entities work together hand in hand. It is indeed of great pleasure for Malta to have welcomed representatives from registries across Europe discussing a subject that is dominating amongst registers fora’ said Dr. Spiteri Lucas. \nAlfred Zammit\, Deputy Director at the Financial Intelligence Unit of Malta\, explained that Beneficial Ownership registries are becoming an increasingly important component in the fight against ML/FT\, but transitioning from a registry to a competent authority is easier said than done. Sharing best practice and exploring different forms of cooperation\, including with FIUs and other authorities\, is therefore very-much needed and a step that we and the community all stand to gain from. \nSupport to partner countries’ Beneficial Ownership frameworks is a key pillar of the EU Global Facility on AML/CFT’s work around the globe. More specifically it will review how legal professions and accountants\, and their self-regulated bodies\, adequately apply AML/CFT preventive measures commensurate with their risks\, and report suspicious transactions. \nIn the second day\, a technical training for ML/TF self-regulated bodies will be delivered. Almengor highlighted that the presentation of the Guide is generated as part of the implementation of Law No. 129 of March 17\, 2020\, which creates the Single Private System for the Registry of Final Beneficiaries of Legal Entities and its regulatory Decrees. \nVice-Minister Gordón emphasized that “(The) initiatives such as this Guide\, are part of the fundamental building blocks of the regulatory and operational reforms which allow us to guarantee the integrity and transparency of all legal persons and arrangements throughout the country\, in accordance with the international standards which we have committed to ». \nFor its part\, the SSNF underlined the importance of the work undertaken by Panama and SSNF over the last few years to achieve delisting from the FATF list. “It has involved the establishment of a legal framework in line with international standards\, but also the development of tools to assist the private sector and resident agents in their work of identifying\, verifying and registering beneficial owners\,” explained Dayra Carrizo\, Superintendent of SSNF.  \nShe added: “The effectiveness of the mechanisms put in place in Panama depends on the commitment of all stakeholders\, and noted the importance resident agents are playing in the institutional set-up of Panama for which they are a key component. These workshops aimed to strengthen the basis for coordination between these stakeholders which commitment is paramount for Panama to be able to demonstrate the effectiveness of the measures taken to ensure the availability and accessibility of BO information in Panama.” \nOver the course of four days\, more than 500 participants attended the training onsite and online. \n“This demonstrate the huge interest and commitment in the subject matter\, and is the materialisation of the efforts undertaken by Panama with regards to its compliance with the Financial Action Task Force’s (FATF) requirements related to transparency of legal persons and arrangements\, amongst the most challenging FATF Recommendation\, and one for which the effectiveness of the measures taken is likewise most difficult to establish and demonstrate\,” stated Alexandre Taymans\, Key Expert on Beneficial Ownership for the EU Global Facility. \nExperts from the SSNF and the Global Facility delivered sessions covering a wide range of topics including the FATF and EU standards\, the newly published SSNF’s Beneficial Ownership Guidance\, the practical functioning of the Panamanian BOR\, the role and strategy of the SSNF to guarantee compliance with the Beneficial Ownership identification and registration requirements. She emphasised the need for enhanced cooperation and shared BO Information related to financial and economic crimes\, encouraging countries to “build systems and learn about what other countries are doing  to change legislation\, how they maintain accurate and update BO information and how this information should be shared with stakeholders  in the value chain of AML/CFT regime.” \nFor his part\, EU Global Facility Team Leader David Hotte\, welcomed the participation of representatives from 18 countries\, saying “it is particularly impressive to witness the attendance of so many countries\, which shows African nations’ committment to the enhancement of beneficial ownership frameworks within their respective jurisdictions. I am confident that these three days of exchanges will yield great results with regards to transparency of legal persons and legal arrangements.” \nThe workshop\, which will consist of interactive exchanges and thematic presentations\, will allow participants to exchange best practices and further deepen their expertise on BO-related matters. \n“Due to the current challenges faced by countries in understanding the issues of BO\, the ESAAMLG is having 18 of its member countries participate in this important event aimed at building more awareness on how countries can comply with the Financial Action Task Force’s standards on BO and how to implement relevant measures. Our Secretariat is confident that the workshop will go a long way in assisting members to come up with effective systems to handle BO\,” stated Expert Joseph Jagada from the ESAAMLG secretariat. \nThe conference is part of a series of technical assistance activities delivered by the EU GF-AML/CFT to third countries around the world. Demand driven and tailored made\, the support is provided on a bilateral\, regional and thematic basis. As of September 2022\, the project has delivered bilateral assistance to 16 countries globally. \n  \n—- \nThe regional workshop “Enhancing Effectiveness of Beneficial Ownership Frameworks: Evolving Technical Standard and their Effective Implementation” will take place in a hybrid format (onsite and online) on 13-15 September 2022 in Lusaka\, Zambia. \nThe regional event is co-organised by the EU Global Facility on AML/CFT\, the ESAAMLG Secretariat and the Financial Intelligence Centre of the Republic of Zambia (FIC). \nThe workshop has been designed to allow participants to exchange and further their expertise in the following areas : \n\nThe FATF and EU standards related to beneficial ownership and the transparency of legal persons (LP) and legal arrangements (LA)\,\nThe importance of country-wide assessments of the ML/TF risks associated with LP/LA as well\, the methodology developed by the Global Facility and case studies presented by Ghana\, Mauritius and the United Kingdom\,\nThe role (public) beneficial ownership registers is expected to play in future AML/CFT frameworks\, the Global Facility’s methodology for their implementation as well as country case studies\,\nThe role of FI/DNFBP in ensuring the availability and accessibility of beneficial ownership information within a jurisdiction\,\nThe practical tools and solutions available to supervisors to design and implement risk-based supervision strategies on beneficial ownership identification/verification obligations\,\nThe practical considerations and concrete actions a jurisdiction can take The meeting was followed by the 5th ESSAAMLG AML/CFT Public-Private sector dialogue (PPSD) on virtual assets and the implementation of AML/CFT programmes in the ESSAMLG region. \nOn the Agenda for the EU Global Facility: \n\n✔︎ Participation in the Technical Assistance Coordination Forum where the bilateral and regional activities conducted by the EU GF in the region will be discussed in addition to forthcoming events.\n✔︎Liaison with the delegations from partner countries with which the EU GF is already engaged.\n✔︎ The EUGF will also follow up on the work achieved by the ESAAMLG\, such as the publication of the regional survey on de-risking/correspondent banking\, which was the topic of the regional conference organised by the EUGF in May 2022 in Mauritius.\n\nThe EU Global Facility is pleased to note that a number of TA activities implemented in partner states -as well as upcoming ones- have been reflected in the documents adopted by the ESAAMLG.
